Carman’s Quarterly Care Package Giveaway Terms & Conditions 2024
TERMS AND CONDITIONS
- Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- The promoter is Carman’s Fine Foods Pty Ltd ABN 37109 604 202 of 11 Hume Street, Huntingdale Victoria 3166 (“the Promoter”).
- The promotion is only open to Australian residents only. Must be over 18 to enter.
- Entry into the promotion opens at 12:00am AEDST on 15 November 2024 and closes at 11:59pm AEDST on 31 December 2024 (“Promotional Period”). Entries outside of this period will not be valid.
- To be eligible to enter, each entrant must:
- Complete the entry form and provide consent to receive marketing emails from the Promoter.
- The Prize draw will take place at Carman’s Office 14 January 2025 at 12pm AEDST. The Promoter may draw additional entries and record them in order in the event that an invalid entry or ineligible entrant is drawn. The Promoter will draw 20 prize winners from all valid entries received during the Promotional Period.
- The first twenty drawn eligible entrants will win a Carman’s product package with a value of $100 RRP. Winners will be notified via email to the winner’s email address. Prizes will be sent to winners at the address on their entry form on 28 January 2025.
- The total prize pool value is up to AUD$2,000.
- Prizes or any unused portion of a prize, are not transferable, changeable or redeemable for cash.
- If any prize (or an element of a prize) is unavailable, the promoter, in its discretion, reserves the right to substitute the Prize (or that element of a prize) with a prize of greater or equal value, subject to any written directions from a regulatory authority.
- If for any reason a winner does not take/redeem a prize (or an element of a prize) at/by the time stipulated by the Promoter, for any reason, then the prize (or that element of the prize) will be forfeited, and no compensation will be payable.
- In the event an invalid or ineligible entry is drawn, or the Promoter is unable to contact a winner within ten (10) days of the first attempting to notify that winner, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid, and no compensation will be payable.
- Acceptance of any prize is deemed consent for the Promoter to use the winner’s name, likeness, image and /or voice for promotional and media purposes without compensation, and any copyright will vest in the Promoter.
- The promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Errors and omissions may be accepted at the promoter’s discretion. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- If there is a dispute as to the identity of an entrant, the promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
- The promoter’s decision is final and no correspondence will be entered into.
- All entries become the property of the Promoter.
- The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons.
- The Promoter and its associated agencies and companies accept no responsibility for prize damaged or lost in transit.
- If the promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including, but not limited to, technical difficulties or unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- To the extent permitted by law, the Promoter and its agents take no responsibility for any failure of any entry to be entered into the promotion due to, without limitation, technical malfunction or human error. The Promoter and its agents are not responsible for late, lost or misdirected entries. Incomplete or indecipherable entries will be deemed invalid.
- As a condition of participating in the promotion, each winner indemnifies the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with this promotion against all claims, damages, liabilities, costs and expenses (including costs on a solicitor-client basis) which a winner may incur arising out of their participation in the promotion and/or use of a prize, howsoever caused. For the sake of clarity, nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act (ASIC) Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia.
- Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected; (d) any variation in the prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a prize.
- The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to a claimant’s or any other person’s mobile device or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
- If there is an event beyond the promoter’s control which causes an interruption to its processing of the promotion the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant Regulatory Authority.
- In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a Major Prize, subject to any written directions from a relevant regulatory authority.
- The Promoter collects and holds personal information provided by entrants for the purposes of this promotion and for future promotional purposes. For this promotion, which includes notifying the winners and facilitating redemption/supplying of a prize, the Promoter may pass the winners’ personal details to their agencies and other associated organisations. Failure to provide requested personal information may disqualify a person from being able to enter the promotion and/or receive the Prize. All personal information provided by entrants will be held by the Promoter and used and handled in accordance with its Privacy Policy, which can be viewed at https://carmanskitchen.com.au/privacy-policy/#:~:text=Carman’s%20may%20use%20third%20party,and%20not%20from%20third%20parties.
- In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Under the Privacy Act 1988 (Cth), entrants have the right to access and correct any such personal information. Entrants may opt out, access and request correction of any of their details held by the Promoter by sending an email to hello@carmanskitchen.com.au. The Promoter will not disclose PI to any entity outside of Australia.
